Former Dallas cowboy Herschel Walker retains Texas waiver while running in Georgia ` Texas

Former Dallas Cowboys running back Herschel Walker continues to claim his home in Tarrant County as his primary residence in Texas as the first-time political nominee seeks a US Senate seat in Georgia. Walker has the backing of conservative Republican politicians, from Texas Senator Ted Cruz to former President Donald Trump.

Tarrant County Appraisal District records confirm that a Walker home in Westlake is subject to a Homestead General exemption on the property, which has an estimated total value of $3,080,000 as of 2022.

Walker faces a Dec. 6 runoff against Democrat Raphael Warnock in the election, one of the most watched races in the 2022 midterm elections nationwide.

Texas law states that β€œto qualify for the general residence exemption, a person must have an ownership interest in the property and use the property as the person’s primary residence. An applicant must declare that he or she is not claiming an exemption for any other residence inside or outside of Texas.”

The Texas Comptroller’s website further states, “If you are temporarily moving away from your home, you may continue to receive the exemption if you do not establish another primary residence, you intend to return to the home, and are away for less than two years. You may continue to receive the exemption if you have not resided in the place of residence for more than two years, only if you are serving in the military inside or outside the United States, or live in a facility that provides services related to health, infirmity, or aging.”

Walker registered in Atlanta to vote in 2021 after living in Texas for two decades and rarely voting, CNN reported. The Heisman Trophy winner and former Cowboys star, who also played for Trump’s New Jersey Generals in the United States Football League, had not publicly responded to reports of his Texas leave of absence as of Thursday noon.

There have been criticisms and questions about Walker’s whereabouts since last year, when he began openly exploring the possibility of running for the Georgia Senate. That state has 15 rules related to running for office and voting in Georgia, not all of which are required to be met, that are considered when establishing residency there, CNN also reported. Requirements under the US Constitution dictate that a prospective Senator must be a resident of his state at the time of his election.

Anthony Michael Kreis, a law professor at Georgia State University, told CNN that state law is flexible when it comes to determining residency for eligibility to run and Walker’s biggest problem may ultimately be political in nature.
